The Nigeria Basketball Federation has encouraged basketball stakeholders to disregard an unsigned press release attributed to the Permanent Secretary of the Federal Ministry of Youth and Sports (FMY&S) that was circulated on multiple social media platforms, postponing the NBBF elections indefinitely.

The decision to postpone the Elective Congress scheduled for Benin City, Edo State on October 30th, 2021, as approved by the NBBF Extra Ordinary Congress on October 9th, 2021, in Abuja, is in violation of the 2019 NBBF approved Statutes.

According to a statement signed by the federation's Caretaker Chairman, Engr Musa Kida, the alleged postponement is unconstitutional and a blatant usurpation of the NBBF Congress's powers as established in the 2019 NBBF Statutes.

After the ministry and the Nigeria Olympic Committee confirmed the existence of a valid constitution sanctioned by the Federation of International Basketball Associations in conducting its affairs as dictated by the NBBF constitution on numerous occasions, the statement described the move as repugnant to natural justice, equity, good conscience, and an arbitrary use of power.

"After the FIBA fact-finding team's visit to Nigeria in 2018, FIBA had put to rest who is the recognized President of the NBBF, supported by pronouncements by the Nigerian Courts." The postponing of a validly approved Elective Congress under the guise of a non-existent leadership squabble is thus intended to deceive all parties involved in order to excuse this illegal act.

The move was in direct contradiction to the Ministry's letter dated October 30, 2021, which recognized the NBBF as one of six national sporting federations with authorized constitutions to govern their electoral processes.
"FIBA wrote a letter affirming that it had approved the NBBF Constitution, which shall be the document to drive the NBBF 2021 Elections, at the request of the Nigeria Olympic Committee (NOC)."
"Following several meetings convened by the ministry and the NOC between the Chairman, Caretaker Committee, and former NBBF President, Tijani Umar, the FMY&S issued a Press Statement on September 30, 2021, stating that the NBBF constitution approved by FIBA is sacrosanct and its provisions shall be the binding document for the conduct of the 2021 NBBF Elections," the statement continued.

All of these events culminated in the Extraordinary Congress in Abuja on October 9, 2021, which established an Electoral and Appeals Committee and approved Benin as the venue for the Elective Congress (by 24 Yes votes to 2 No votes), in strict accordance with the 2019 NBBF rules.
The Permanent Secretary, who issued the Press Release postponing the Elective Congress indefinitely, gave the keynote presentation during the extraordinary congress, which also included a representative from the NOC and Dr. S. Evbojaiye, Director FEAD at the FMY&S.

After the ministry agreed that only the NBBF Congress has the authority to act in accordance with the NBBF Statutes, Kida noted this left a lot to be desired.
All plans for the Elective Congress in Benin have been made, and FIBA has chosen a representative to oversee the Elective Congress, so all delegates and aspirants should be aware that the NBBF's Elective Congress, as approved by the Extraordinary Congress, will take place as planned.
